01ההסכם

תנאים אלה הם הסכם מחייב בינך לבין המפעילים של בוקר שוקר (להלן "האפליקציה", "אנחנו"). הורדת האפליקציה, פתיחתה או רכישת מנוי מהוות הסכמה לתנאים ולמדיניות הפרטיות. אם אינך מסכים — אל תשתמש באפליקציה, ומחק אותה.

בנוסף לתנאים אלה חל גם הסכם הרישיון הסטנדרטי של Apple למשתמש קצה. במקרה של סתירה, התנאים כאן גוברים ככל שהדבר מותר לפי כללי Apple.

02מי רשאי להשתמש

השימוש מותר למי שמלאו לו 16 שנים. אם טרם מלאו לך 18, השימוש והרכישה מותרים רק בהסכמת הורה או אפוטרופוס האחראי לחשבון ה-Apple ID שממנו מתבצע החיוב.

03הרישיון שניתן לך

אנחנו מעניקים לך רישיון אישי, מוגבל, לא בלעדי ולא ניתן להעברה, להשתמש באפליקציה על מכשירי iPhone שבבעלותך או בשליטתך, לשימוש פרטי ולא מסחרי. האפליקציה ניתנת ברישיון — היא אינה נמכרת לך.

04מה השעון עושה — ומה לא

האפליקציה קובעת שעון מערכת ב-iOS (AlarmKit) שממשיך לצלצל עד שהמשימה מושלמת. הצלצול תלוי במערכת ההפעלה, בהרשאות פעילות, בסוללה טעונה ובכך שהמכשיר דולק ותקין.

05בריאות ובטיחות

המשימה כוללת שכיבות סמיכה — מאמץ גופני לכל דבר, בדקות הראשונות אחרי היקיצה. אם יש לך פציעה, מגבלה רפואית, בעיית לב, הריון או ספק כלשהו, היוועץ ברופא לפני השימוש. הפסק מיד אם אתה חש כאב, סחרחורת או קוצר נשימה.

בצע את המשימה במרחב פנוי, על משטח יציב, הרחק מרהיטים ומקצה המיטה. האפליקציה אינה מכשיר רפואי, אינה מספקת ייעוץ רפואי או אבחון, אינה מטפלת בהפרעות שינה ואינה תחליף לשינה מספקת. ציון הבוקר הוא מדד מוטיבציה, לא מדד בריאותי.

06דרישות מכשיר והרשאות

האפליקציה מיועדת ל-iPhone עם iOS 26 ומעלה, ודורשת הרשאת מצלמה, הרשאת שעונים והשמעת אודיו. לאימות התנוחה נדרשים תאורה סבירה ומרחב שבו הגוף נראה במצלמה. ביטול הרשאה בהגדרות iOS ישבית את הפונקציה המרכזית של האפליקציה, ואין בכך עילה להחזר.

07מנוי, חיוב וחידוש

• הגישה המלאה נמכרת כמנוי מתחדש אוטומטית דרך ה-App Store.
• המחיר, אורך התקופה והמטבע מוצגים במסך הרכישה לפני האישור, והחיוב נגבה מחשבון ה-Apple ID שלך עם האישור.
• המנוי מתחדש לתקופה זהה, אלא אם ביטלת לפחות 24 שעות לפני תום התקופה הנוכחית. Apple גובה את החידוש בתוך 24 השעות שלפני תום התקופה.
• ניתן לבטל בכל עת דרך הגדרות ← ה-Apple ID שלך ← מנויים. הביטול נכנס לתוקף בתום התקופה ששולמה, והגישה נשמרת עד אז.
• הסרת האפליקציה אינה מבטלת את המנוי.
• החזרים כספיים מטופלים על ידי Apple בלבד, דרך reportaproblem.apple.com. לנו אין גישה לחיובים ואין יכולת לזכות אותך ישירות.

08תקופת ניסיון ושינויי מחיר

אם מוצעת תקופת ניסיון או הצעת היכרות, תנאיה מוצגים במסך הרכישה. בתום התקופה המנוי עובר לחיוב מלא, אלא אם בוטל לפחות 24 שעות קודם לכן. אם תרכוש מנוי בזמן שתקופת ניסיון פעילה, יתרתה תפוג.

שינוי מחיר לא יחול על תקופה ששולמה. Apple תודיע לך על שינוי מחיר ותבקש את אישורך לפני החידוש הבא, בהתאם למדיניותה.

09שחזור רכישה וחשבון אנונימי

האפליקציה פועלת ללא הרשמה, והחשבון שלה הוא מזהה אנונימי במכשיר. לכן היסטוריית הקימה והשעונים אינם עוברים למכשיר חדש או שורדים התקנה מחדש. המנוי כן — הוא מזוהה מול חשבון ה-Apple ID שלך, וניתן לשחזר אותו בכפתור "שחזור רכישה" שבמסך ההגדרות.

10שימוש הוגן

• אין לעקוף את המשימה באמצעים טכניים, לרבות הצגת וידאו או תמונה למצלמה, שינוי שעון המערכת או התערבות בקוד.
• אין לבצע הנדסה לאחור, פירוק או שכפול של האפליקציה, למעט במידה שהדין מתיר במפורש.
• אין להשתמש באפליקציה בזמן נהיגה, הפעלת מכונות או בכל מצב שדורש את מלוא תשומת הלב.
• אין להשתמש באפליקציה באופן שפוגע בשירות, בשרתים או במשתמשים אחרים.

הפרה של סעיף זה עלולה להוביל לחסימת הגישה, ללא החזר.

11קניין רוחני

האפליקציה, השם "בוקר שוקר", הלוגו, הצלילים, הטקסטים והעיצוב הם רכושנו ומוגנים בדין. אין להעתיק, להפיץ או לעשות בהם שימוש מסחרי ללא אישור בכתב. הנתונים שהזנת — השעונים וההיסטוריה — נשארים שלך; ראה את מדיניות הפרטיות.

12זמינות, עדכונים והפסקת שירות

אנחנו רשאים לעדכן את האפליקציה, לשנות פיצ'רים או להפסיק את השירות. אם נפסיק את השירות בזמן שמנוי בתוקף, נודיע מראש באפליקציה, והחזר יחסי — ככל שיגיע — יטופל דרך Apple. תחזוקה מתוכננת או תקלה אצל ספק עלולות לגרום להשבתה זמנית.

13שירותי צד שלישי

האפליקציה נשענת על Apple (חנות, שעונים, תשלום), Supabase (בסיס נתונים) ו-RevenueCat (ניהול מנויים). השימוש בהם כפוף גם לתנאים ולמדיניות שלהם, ואיננו אחראים לתקלות או לשינויים בשירותים אלה.

14היעדר אחריות

האפליקציה ניתנת כמות שהיא (AS IS) ולפי זמינותה. איננו מתחייבים שהיא תפעל ללא תקלות או הפרעות, שהזיהוי במצלמה יהיה מדויק בכל תנאי תאורה ותנוחה, או שתשיג תוצאה כלשהי בהרגלי השינה או הקימה שלך. אין בסעיף זה כדי לגרוע מזכויות שאינן ניתנות להתניה לפי חוק הגנת הצרכן, התשמ"א-1981.

15הגבלת אחריות

במידה המרבית שהדין מתיר, לא נישא באחריות לנזק עקיף, תוצאתי או מיוחד, לרבות אובדן הכנסה, החמצת אירוע או פגיעה שנגרמה במהלך ביצוע המשימה. אחריותנו הכוללת בכל עילה לא תעלה על הסכום ששילמת בפועל עבור המנוי ב-12 החודשים שקדמו לאירוע.

16תפקידה של Apple

• Apple אינה צד להסכם זה, וההסכם הוא בינך לבינינו בלבד.
• אנחנו, ולא Apple, אחראים לאפליקציה, לתוכן שבה ולתמיכה בה.
• אם האפליקציה אינה תואמת לאחריות החלה לפי דין, ניתן להודיע ל-Apple, ו-Apple תשיב את מחיר הרכישה, ככל ששולם. מעבר לכך, ובמידה שהדין מתיר, ל-Apple אין חבות נוספת.
• Apple וחברות הבת שלה הן מוטבות צד שלישי של תנאים אלה ורשאיות לאכוף אותם.

17דין וסמכות שיפוט

על תנאים אלה חלים דיני מדינת ישראל, ללא כללי ברירת הדין שלהם. סמכות השיפוט הייחודית נתונה לבתי המשפט המוסמכים בתל אביב-יפו. אם אתה צרכן במדינה אחרת, אין בכך כדי לגרוע מזכויות כופות שמוקנות לך במקום מגוריך.

18שינויים בתנאים

נעדכן את התנאים מעת לעת ונשנה את תאריך העדכון בראש הדף. שינוי מהותי יוצג באפליקציה לפני שייכנס לתוקף. המשך שימוש לאחר מכן מהווה הסכמה לנוסח המעודכן.

01The agreement

These terms form a binding agreement between you and the operators of Boker Shoker (the "app", "we"). Downloading the app, opening it or buying a subscription means you accept these terms and the privacy policy. If you do not accept them, do not use the app and delete it.

Apple's Standard End User Licence Agreement also applies. Where the two conflict, these terms prevail to the extent Apple's rules allow.

02Who may use the app

You must be at least 16 to use the app. If you are under 18, you may use it and make purchases only with the consent of the parent or guardian responsible for the Apple ID being billed.

03Your licence

We grant you a personal, limited, non-exclusive, non-transferable licence to use the app on iPhones you own or control, for private and non-commercial purposes. The app is licensed to you, not sold.

04What the alarm does — and does not

The app schedules an iOS system alarm (AlarmKit) that keeps ringing until the mission is completed. Whether it rings depends on the operating system, on permissions staying granted, on a charged battery, and on the device being switched on and working.

05Health and safety

The mission involves push-ups — real physical exertion, in the first minutes after waking. If you have an injury, a medical condition, a heart problem, are pregnant, or have any doubt, consult a doctor before using the app. Stop immediately if you feel pain, dizziness or shortness of breath.

Perform the mission in clear space, on stable ground, away from furniture and the edge of the bed. The app is not a medical device. It does not provide medical advice or diagnosis, does not treat sleep disorders, and is no substitute for enough sleep. The wake score is a motivational measure, not a health measure.

06Device requirements and permissions

The app is built for iPhone running iOS 26 or later, and needs camera access, alarm access and audio playback. Verifying your position requires reasonable light and enough space for your body to be visible to the camera. Revoking a permission in iOS Settings disables the core of the app, and is not grounds for a refund.

07Subscription, billing and renewal

• Full access is sold as an auto-renewing subscription through the App Store.
• The price, period length and currency are shown on the purchase screen before you confirm, and your Apple ID is charged on confirmation.
• The subscription renews for the same period unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before the period ends.
• You can cancel at any time in Settings → your Apple ID → Subscriptions. Cancellation takes effect at the end of the paid period, and access continues until then.
• Deleting the app does not cancel the subscription.
• Refunds are handled solely by Apple, at reportaproblem.apple.com. We have no access to billing and cannot refund you directly.

08Free trials and price changes

Where a free trial or introductory offer is available, its terms are shown on the purchase screen. At the end of the trial the subscription converts to the full price unless cancelled at least 24 hours earlier. If you buy a subscription while a free trial is running, any unused part of the trial is forfeited.

A price change never applies to a period already paid for. Apple will notify you of a price change and ask for your consent before the next renewal, in line with its own policy.

09Restoring purchases and anonymous accounts

The app works without sign-up, and its account is an anonymous identifier held on the device. As a result, your wake history and alarms do not move to a new device and do not survive a reinstall. Your subscription does — it is tied to your Apple ID, and you can bring it back with "Restore purchase" on the settings screen.

10Fair use

• Do not defeat the mission by technical means, including showing the camera a video or a photo, changing the system clock, or interfering with the app's code.
• Do not reverse-engineer, decompile or copy the app, except where the law expressly permits it.
• Do not use the app while driving, operating machinery, or in any situation demanding your full attention.
• Do not use the app in a way that harms the service, our servers or other users.

Breaching this section may result in access being blocked, without a refund.

11Intellectual property

The app, the name "Boker Shoker", the logo, the sounds, the text and the design are ours and are protected by law. They may not be copied, distributed or used commercially without written permission. The data you enter — your alarms and history — remains yours; see the privacy policy.

12Availability, updates and discontinuation

We may update the app, change features, or discontinue the service. If we discontinue it while your subscription is active, we will give notice in the app, and any pro-rata refund due is handled through Apple. Planned maintenance or a provider outage may cause temporary downtime.

13Third-party services

The app relies on Apple (store, alarms, payment), Supabase (database) and RevenueCat (subscription management). Your use is also subject to their terms and policies, and we are not responsible for faults or changes in those services.

14No warranty

The app is provided AS IS and as available. We do not warrant that it will run without faults or interruptions, that camera detection will be accurate in every lighting condition and posture, or that it will produce any particular result for your sleep or waking habits. Nothing here limits rights that cannot be waived under Israel's Consumer Protection Law, 5741-1981, or equivalent consumer law where you live.

15Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, consequential or special damage, including lost income, a missed event, or injury sustained while performing the mission. Our total liability on any basis will not exceed the amount you actually paid for the subscription in the 12 months before the event.

16Apple's role

• Apple is not a party to this agreement, which is between you and us alone.
• We, and not Apple, are responsible for the app, its content and its support.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any was paid. Beyond that, and to the extent the law allows, Apple has no further obligation.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

17Governing law and jurisdiction

These terms are governed by the laws of the State of Israel, excluding its conflict-of-law rules. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction. If you are a consumer elsewhere, this does not remove mandatory rights granted to you where you live.

18Changes to these terms

We will update these terms from time to time and change the date at the top of the page. A material change will be surfaced in the app before it takes effect. Continuing to use the app afterwards means you accept the updated version.
